2. Acceptance of the terms

By accessing www.monarhdesign.com and/or placing an online order, you declare that you have read, understood, and fully accepted the terms and conditions on this page.

Monarh reserves the right to change these terms without prior notice. Changes take effect when published on this page.

3. Products and availability

All products displayed on the website include a description, price, and representative images. Products are made in our own atelier.

Product availability:

  • Some products are in stock; others are made to order.
  • Production times are specified on each product page.
  • If a product is unavailable, the customer will be notified as soon as possible.

Monarh reserves the right to select which orders it fulfils according to production capacity and fabric availability.

4. Prices and payment methods

All prices are shown in RON, dollars, or EUR, depending on the customer's location, and include VAT as required by applicable law.

Prices may change without prior notice, but changes do not apply to orders already processed.

Available payment methods:

  • Online card payment through the secure Shopify Payments processor (3D Secure – Visa, Mastercard, Maestro).
  • Cash on delivery, where applicable, for orders within Romania only.

Full payment is required for an order to be processed. For online payments, products are dispatched only after the transaction is confirmed.

5. Delivery

Monarh delivers throughout Romania and internationally, without exceptions.

Estimated delivery times:

  • In-stock products: 2–5 business days
  • Made-to-order products: 7-21 business days
  • Preorders and couture pieces: up to 60 business days, as specified on the product page. 

Courier services used:

  • DHL for international deliveries
  • GLS for deliveries within Romania

Orders received at weekends or on public holidays are processed from the next business day.

Parcels are delivered by GLS. Shipping costs 25 lei to any destination in Romania.


Delivery costs to other countries are displayed at checkout and vary by destination and weight. Orders qualifying for free shipping show this benefit in the shopping basket.

Monarh cannot be held liable for delivery delays or failures caused by external factors, including force majeure such as pandemics, strikes, or customs disruptions.

 


6. Return policy

Under applicable law, customers may return purchased products within 14 calendar days of receipt, except for personalised or made-to-order products.

Return eligibility:

  • The product is unworn, unwashed, and unaltered.
  • Tags and original packaging are intact.
  • There are no signs of wear, stains, odours, or damage.

Return exclusions:

  • Made-to-order products or products in custom colours
  • Products from the Final Sale or Archive Sale sections

Return fees:

  • Romania: free
  • EU: 99 EUR per item
  • USA and rest of the world: 35% of the product value, covering customs duties and taxes
  • Missing original packaging incurs an additional fee of 19 EUR / 22 USD/100RON
  • Products returned in an unacceptable condition receive a partial refund, with 30% withheld.
  • For parcels refused on delivery, 30% of the order valuewill be withheld.


Returns must be sent exclusively using approved couriers: DHL for international returns, and GLS, FanCourier, Cargus, or Sameday for Romania. Products must be sent in one parcel with the return pro forma invoice and airway bill (NOT REQUIRED FOR ROMANIA).

6.1. Right of withdrawal

Under Emergency Ordinance no. 34/2014, consumers may withdraw from the contract without giving a reason within 14 calendar days of receiving the product.

Exceptions to the right of withdrawal

Under Article 16(c) of Emergency Ordinance 34/2014, products made to the customer's specifications, such as made-to-measure or personalised products, are excluded from the right of withdrawal.


7. Refunds

Refunds are processed within 14 business days of receipt of the returned parcel and paid to the account used for payment.

Shipping costs are non-refundable. If the original delivery was free, the actual shipping cost will be deducted from the refund.

8. Limitation of liability

Monarh cannot be held responsible for:

  • Direct or indirect damage caused by use of the website
  • Display errors relating to prices, images, colours, or descriptions
  • Delivery delays caused by postal or customs services
  • Products being out of stock or orders that cannot be fulfilled
  • Orders placed with incorrect customer information
  • Minor differences in shade, cut, or details between handmade products

By using www.monarhdesign.com, customers accept full responsibility for their actions and the accuracy of the information they provide.

8.1. Product warranty

Products are covered by the statutory conformity guarantee under Emergency Ordinance 140/2021. The guarantee does not cover normal wear or defects caused by misuse, incorrect washing, or unsuitable storage.

8.2. Handmade characteristics

Handmade products may show slight variations in shade, stitching, or details; these are not considered defects.

9. Intellectual property rights

All elements of www.monarhdesign.com – including, without limitation, its design, logo, photographs, text, videos, product descriptions, source code, and layout – are the exclusive property of S.C. Atelier Monarh S.R.L. or its contractual partners.

Using, copying, reproducing, distributing, modifying, or publishing any content, in whole or in part, without the rights holder's written consent is strictly prohibited and infringes copyright and intellectual property law.

Any attempt to compromise website security, access data or code without permission, or use content for unauthorised commercial purposes will be reported to the competent authorities.

10. Customer account

By creating an account on www.monarhdesign.com, customers can view orders, manage returns, and create wishlists. Customers alone are responsible for keeping their login credentials confidential.


11. Privacy and data protection

By using the website and placing orders, customers expressly consent to the collection and processing of their personal data for order delivery, payment processing, and commercial communications.

Data is processed in accordance with applicable national and European legislation, including Regulation (EU) 2016/679 (GDPR).

Monarh undertakes to protect the privacy and security of personal data and will not disclose it to third parties without a legal basis. The only exceptions are contractual partners involved in processing orders: courier companies and payment processors.

12. Promotional campaigns and competitions

Campaigns and promotions on www.monarhdesign.com are governed by their own rules, published on dedicated pages or communicated through the newsletter.

Promotions apply only to orders placed during the stated period, subject to their terms and available stock. Discounts cannot be combined unless expressly stated.

13. Jurisdiction and dispute resolution

All contracts concluded through www.monarhdesign.com are governed by Romanian law.

Any disagreement or dispute between the parties will first be addressed amicably. If an amicable settlement is not possible, disputes will be referred to the competent courts in Dâmbovița.

13.2. ANPC complaints

Customers in Romania may submit complaints to the National Authority for Consumer Protection (ANPC): www.anpc.ro



 

14. Final provisions

These terms constitute the entire agreement between the customer and S.C. Atelier Monarh S.R.L. regarding use of the website and the purchase of products.
